Tabaqat al-Masa'il
Masail al-Usul / Zahir al-Riwaya
- Issues in the books narrated from Muhammad b. al-Hasan via manifest, established transmission are given fatwa upon; even if not explicitly verified
- al-Mabsut, al-Ziyadat, al-Jamiʿ al-Saghir, al-Jamiʿ al-Kabir, al-Siyar al-Saghir, al-Siyar al-Kabir; all by Muhammad b. al-Hasan al-Shaybani (d. 189H)

Masail al-Nawadir
- Al-Shaybani also authored Masa'il al-Nawadir works, whose chain of transmission is not clearly apparent in the books — hence "non-zahir riwaya"
- First class: books other than Muhammad's; like Kitab al-Mujarrad by al-Hasan b. Ziyad, and the Amali of Abu Yusuf
- Second class: solitary narrations; like Ibn Samaʿa (d. 233H)'s narration, Muʿalla b. Mansur (d. 211H)'s, and others on specific issues

Masail al-Nawazil = al-Waqiʿat = al-Fatawa — One Third Tier, Three Names
- Verse 16 names this rank "al-nawazil"; the very same rank is headed "al-Fatawa wa al-Waqiʿat" in Abu Lubaba's hashiya (al-Rashid print, p. 69) — three names for one later-generated tier, distinct from al-Usul and al-Nawadir
- Abu Lubaba titles the whole third rank "al-Fatawa wa al-Waqiʿat," confirming it IS the tier the matn calls al-nawazil — not a separate rank
- Cases later mujtahids derived where they found no narration from the founding imams; the same definition stands in both Abu Lubaba's hashiya (p. 69) and Abu al-Hajj's tahqiq
- First al-Nawazil of Abu al-Layth al-Samarqandi (d. 373H), then Majmuʿ al-Nawazil wa al-Waqiʿat of al-Natifi (d. 446H), and al-Waqiʿat of al-Sadr al-Shahid (d. 536H)
- Later scholars mixed these issues together (Fatawa Qadikhan, al-Khulasa); some kept them distinct — al-Muhit of Radi al-Din al-Sarakhsi (d. 571H) lists usul, then nawadir, then fatawa; Ibn ʿAbidin praises this
Are fatwa / waqiʿa / nazila actually distinct? — a two-position ikhtilaf (Abu Lubaba, p. 70)
- Terminology: a fatwa is informing of a shar'i ruling bindingly; a waqiʿa is the plural of an incident — "al-hadithat al-nazila," which itself equates waqiʿa with nazila
- View 1: the three are identical — this is the usage on which the matn (verse 16) and the hashiya heading equate them
- View 2 (strict): equating them is loose usage (tawassuʿ); strictly, ifta only happens in answer to a question, whereas a waqiʿa is what the mufti addresses even unasked — so their relation is ʿumum wa khusus wajhi (partial mutual overlap, not identity)
- Note: even on the strict view the dividing line falls between fatwa (an act, requiring a question) and waqiʿa (an incident); nazila/nawazil groups WITH al-waqiʿat, not against it — so the tier itself stays one, and the old markmap's nawazil-vs-waqiʿat split put the boundary in the wrong place

Why This Tier Ranks Lowest + the Hadith-Science Analogy
- Fatwa compilations rank below the Nawadir: not all of it comes from the founding authorities, it carries no chain to its speaker, and it was gathered by lesser jurists of unknown reliability
- Analogy: the six Usul books = the two Sahihs; the Nawadir = the four Sunan; al-Muhit al-Radawi = Mishkat al-Masabih, gathering both with the tiers kept distinct

Al-Dahlawi's Alternate Fourfold Classification
- Shah Wali Allah al-Dahlawi (d. 1176H)'s four tiers (Iqd al-Jid): (1) what is settled in zahir al-riwaya, accepted unconditionally; (2) an anomalous narration from the three imams, accepted only if it agrees with the usul; (3) a later takhrij the majority of scholars agreed on, given as fatwa unconditionally; (4) a takhrij the majority did NOT agree on, which the mufti must weigh against the usul and analogous cases before adopting
